1. Who We Are and This Agreement

This website is operated by Creative Tops, Inc., doing business as Duralex USA ("Duralex USA," "we," "us"). By using duralexusa.com or placing an order, you agree to these Terms and to our Refund Policy, Shipping Policy and Privacy Policy, which are part of these Terms.

We may update these Terms. Changes apply to orders placed after the updated Terms are posted.

2. Accounts

You must be at least 18, or have a parent or guardian's permission, to place an order. Keep your account details accurate and your password private. You are responsible for activity on your account.

3. Product Information

We show product colors, sizes and capacities as accurately as we can. Colors vary by screen, and glass color can vary slightly between production batches. Please check the capacity (oz or cl) and dimensions (inches) on the product page before ordering; size is not a defect.

Availability is not guaranteed until your order ships.

4. Prices, Orders and Errors

Prices are in US dollars and can change at any time before you order. Your order confirmation email is not our acceptance of your order; we accept it when we ship it.

We may refuse, limit or cancel any order, including orders that appear to be for commercial resale, orders we suspect are fraudulent, and orders that exceed quantity limits. If we cancel after you have been charged, we refund you in full.

Pricing errors. If a product is listed at an obviously incorrect price or with incorrect information, we may cancel orders for that product before shipment, even after confirmation, and refund you in full.

5. Payment

Your payment method is charged when you place your order. You confirm you are authorized to use it. Once an order is placed, we cannot move the charge to a different payment method or reprocess it. Applicable sales tax is added at checkout.

6. Promotions and Discount Codes

• One discount code per order unless the offer says otherwise.
• Codes and sale prices are not applied to past orders. We do not offer price adjustments on previous purchases.
• Codes have no cash value and cannot be exchanged for cash or credit.
• Codes are for the people we send them to. We may cancel codes that are published or shared without our permission, and may cancel orders that use a code in violation of its terms.
• We may change or end any promotion at any time.

7. Shipping, Returns, Title and Risk of Loss

Shipping, returns and damaged items are covered by our Shipping Policy and Refund Policy. We are responsible for your order until the carrier delivers it to the address you gave us at checkout. Title passes to you on delivery.

8. Rewards and Referral Program

Our rewards and referral program is described on our Rewards page. By participating, you agree that:

• Points and rewards have no cash value and cannot be transferred or sold.
• Points expire as stated on the Rewards page.
• Points earned on orders that are later returned or cancelled are removed.
• Referral rewards are for new customers only. Self-referrals, multiple accounts, and referrals to the same household or address are not eligible.
• We may cancel points, rewards or accounts obtained through fraud or abuse.
• We may change or end the program, and will post changes on the Rewards page before they take effect.

9. Reviews, Photos and Content You Share

When you post a review, photo or video about our products, or tag us on social media and agree to let us use it, you give us a non-exclusive, royalty-free license to use, reproduce and display that content, with your name or handle, in our marketing. Your content must reflect your own honest experience.

We do not remove or hide reviews because they are negative. We may remove content that is abusive, off-topic, contains personal information, or is fraudulent. Any reward we offer for a review is given whether the review is positive or negative.

10. Email and Text Messages

You can unsubscribe from marketing emails at any time with the link in each email. We will still send order and account emails.

Text messages. If you opt in to Duralex USA text messages, you agree to receive recurring automated marketing texts at the number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages.

11. Product Use and Safety

Duralex tempered glass is made to be highly durable, but it is still glass. It can break from impact, misuse, or sudden temperature changes such as moving it from very hot to very cold. When tempered glass breaks, it breaks into many small pieces.

• Follow the use and care instructions on the product page and packaging.
• Stop using any piece that is chipped, cracked or scratched.
• Handle broken glass with care and keep it away from children and pets.

We are not responsible for breakage or injury caused by misuse, improper handling, failure to follow care instructions, or use outside normal household or commercial foodservice use.

12. Warranties

We stand behind our products as described in our Refund Policy, which sets out your remedies for items that arrive damaged, defective or incorrect.

To the extent permitted by law, we make no other warranties, and we limit any implied warranties, including merchantability and fitness for a particular purpose, to the maximum extent allowed. Some states do not allow implied warranties to be disclaimed or limited, so these limits may not apply to you. You may have other rights that vary by state.

13. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of this website or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits liability that cannot be limited by law, including liability for personal injury caused by our negligence where your state does not allow that limit.

14. Website Use and Intellectual Property

Content on this website, including text, photography and design, is owned by us or our licensors and may not be copied or used commercially without our written permission. Duralex, Le Picardie, Le Gigogne and related names and logos are trademarks of their owner and are used under license.

You may not use this website to scrape content, run automated purchasing tools, attempt unauthorized access, or interfere with its operation. Businesses buying for resale or foodservice should apply for a wholesale account.

15. Third-Party Links

Links to other websites are provided for convenience. We are not responsible for their content or privacy practices.

16. Disputes and Governing Law

If you have a problem with an order, please contact us first. Most issues are resolved quickly.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws rules, except where the consumer protection laws of your state of residence apply. You may bring a claim in small claims court where you live if it qualifies.

17. Accessibility

We want our website to be usable by everyone. See our Accessibility Statement, or contact us if you need help placing an order.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. These Terms and the policies they reference are the entire agreement between you and us about your use of this website and your purchases.
